1. Agreement to Terms

By accessing our website or engaging Hitender.biz Digital Agency ("Agency," "we," "us") for any service, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.

2. Services Provided

Hitender.biz provides digital services including but not limited to:

• Website design and development
• AI chatbot development and integration
• WhatsApp automation systems
• Search Engine Optimization (SEO and AEO)
• E-commerce development
• Digital marketing and lead generation

All services are governed by a separate project agreement or Statement of Work (SOW) signed between both parties.

3. Project Engagement & Payment

• Projects commence upon receipt of the agreed advance/deposit payment.
• Payment schedules are specified in individual project proposals.
• All prices are quoted in Indian Rupees (INR) unless otherwise stated.
• Invoices are due within 7 days of issuance unless agreed otherwise.
• Late payments may incur a 2% monthly interest charge.

4. Client Responsibilities

The client agrees to:

• Provide accurate business information, content, and materials required for the project.
• Provide timely feedback within agreed review periods.
• Designate a single point of contact for project communications.
• Ensure all content provided is original or properly licensed.

5. Intellectual Property

• Upon full payment, the client receives ownership of the final deliverables (website code, design assets) created specifically for their project.
• Hitender.biz retains the right to use completed projects in its portfolio unless specifically requested otherwise in writing.
• Any third-party tools, plugins, or frameworks used remain under their respective licenses.
• Pre-existing Agency tools, frameworks, and methodologies remain the property of Hitender.biz.

6. Revisions & Scope Changes

• Each project includes a defined number of revision rounds as specified in the project proposal.
• Additional revisions beyond the agreed scope will be billed at ₹1,500/hour.
• Significant scope changes require a revised proposal and additional payment.

7. Timelines & Delays

Project timelines are estimates based on the information available at project commencement. Delays caused by late content delivery, delayed approvals, or scope changes are not the responsibility of Hitender.biz. The Agency will communicate any timeline adjustments promptly.

8. Cancellation Policy

• Cancellations made before project commencement: Full refund of advance minus 10% administrative fee.
• Cancellations after project commencement: Advance payment is non-refundable. Client will be billed for work completed to date.
• All cancellations must be made in writing via email.

9. Warranty & Support

• Hitender.biz provides a 30-day bug-fix warranty on all completed projects.
• The warranty covers defects in our original deliverables only, not third-party plugin updates or client-made modifications.
• Ongoing maintenance and support are available under separate monthly retainer agreements.

10. Limitation of Liability

Hitender.biz's total liability for any claims arising from our services shall not exceed the total amount paid by the client for the specific project in question. We are not liable for indirect, incidental, or consequential damages including loss of revenue or data.

11. Confidentiality

Both parties agree to keep confidential any proprietary information, business data, or trade secrets shared during the project engagement. This obligation continues for 2 years after project completion.

12. Governing Law

These Terms and Conditions are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.
